These Terms of Use govern your use of the O2Sync NZ website (o2sync.co.nz) and any purchase you make from us. By placing an order or using this website, you agree to these terms. These terms are governed by the laws of New Zealand, including the Consumer Guarantees Act 1993, the Fair Trading Act 1986, and the Contract and Commercial Law Act 2017.
1. About Us
O2Sync NZ is a New Zealand-owned and operated business based in Napier, Hawke's Bay, selling mouth tape and nasal strips direct to consumers. All prices are in New Zealand Dollars (NZD) and are inclusive of GST (15%) unless otherwise stated. We ship to New Zealand addresses only.
2. Placing an Order
When you place an order on our website, you are making an offer to purchase the selected products at the listed price. A binding contract is formed when we confirm your order by email and process your payment via Stripe. We reserve the right to decline any order (for example, where a product is out of stock or a pricing error has occurred), in which case we will provide a full refund.
By placing an order you confirm that:
- You are at least 18 years of age, or have parental or guardian consent
- You are ordering for delivery to a New Zealand address
- The information you have provided is accurate and complete
3. Pricing and Payment
All prices are listed in NZD and include GST. We reserve the right to change prices at any time; however, the price at the time your order is confirmed is the price you will pay. Payment is processed securely by Stripe Inc. We accept major credit and debit cards. We do not store your card details.
If a pricing error occurs on our website, we are not obligated to honour the incorrect price and will contact you to either confirm the correct price or cancel your order with a full refund.
4. Shipping and Delivery
We dispatch all orders from Napier, New Zealand. Our current shipping rates are:
- Standard shipping: $10.00 NZD flat rate
- Free shipping: on orders over $49.00 NZD
- Rural delivery: $15.70 NZD (selected at checkout for rural addresses)
Standard delivery typically takes 1–3 business days. These are estimates only and we are not responsible for delays caused by courier services, public holidays, or events beyond our control. Risk of loss passes to you once we hand your order to the courier.
We currently ship to New Zealand addresses only. We do not ship internationally.
5. Subscriptions
We offer recurring subscription plans for our products. By purchasing a subscription, you authorise us to charge your payment method on a recurring basis at the selected interval until you cancel.
- You may cancel your subscription at any time through the Stripe customer portal, accessible via the link we email to you
- Cancellation takes effect at the end of the current billing period — you will not be charged for subsequent periods
- We do not offer pro-rated refunds for unused portions of a subscription period
- We reserve the right to change subscription pricing with reasonable notice; you may cancel if you do not accept a price change
6. Returns, Refunds and Your Consumer Rights
Your rights under the Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986 are not affected or limited by these terms. Under the CGA, our products come with guarantees that cannot be excluded, including that goods are of acceptable quality, fit for purpose, and match their description.
If a product you receive is faulty, damaged in transit, or does not match its description, you are entitled to a remedy. Depending on the nature of the failure, this may be a repair, replacement, or refund. Please contact us at o2syncnz@gmail.com within a reasonable time of receiving your order.
Because our products are hygienic and single-use in nature, we are unable to accept returns of opened or used products for change-of-mind reasons. For unopened, unused products returned in their original condition within 14 days of purchase, please contact us to arrange a return — return postage costs are at your expense for change-of-mind returns.
We will process approved refunds to the original payment method within a reasonable timeframe.
7. Health and Product Disclaimer
O2Sync NZ products are lifestyle and wellness products designed to encourage nasal breathing during sleep. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition. The information on our website is for general informational purposes only and does not constitute medical advice.
If you have a diagnosed sleep disorder (such as sleep apnoea), a respiratory condition, or any other relevant health concern, please consult a qualified healthcare professional before using our products. Do not use mouth tape if you have a completely blocked nose, have consumed alcohol, or are taking medication that may impair your breathing.
Our products use medical-grade adhesives. If you experience skin irritation, discontinue use and consult a healthcare professional. Individual results will vary.
8. Limitation of Liability
To the extent permitted by law (including the Consumer Guarantees Act 1993), our liability for any claim arising out of or in connection with these terms or your use of our products is limited to the price you paid for the relevant products. We are not liable for indirect, incidental, or consequential losses.
Nothing in these terms limits or excludes any liability that cannot be excluded under New Zealand law, including rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
9. Intellectual Property
All content on this website — including text, images, graphics, logos, and the O2Sync™ trademark — is owned by or licensed to O2Sync NZ and is protected by New Zealand and international intellectual property law. You may not reproduce, distribute, or use any content from this site without our express written permission.
10. Website Use
You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others. You must not attempt to gain unauthorised access to any part of the site, introduce malicious code, or interfere with the site's operation.
We reserve the right to suspend or restrict access to the website at any time without notice.
11. Privacy
Your personal information is collected and used in accordance with our Privacy Policy, which forms part of these terms.
12. Changes to These Terms
We may update these terms from time to time. The current version will always be published on this page with the date of last update. Your continued use of the website after changes are posted constitutes acceptance of the revised terms. Changes do not affect any contract already formed before the change.
13. Governing Law and Disputes
These terms are governed by the laws of New Zealand. Any dispute arising in connection with these terms or a purchase from us will be subject to the exclusive jurisdiction of the New Zealand courts. We encourage you to contact us in the first instance to resolve any dispute informally.
For unresolved consumer disputes, you may contact the Consumer Protection service (Ministry of Business, Innovation and Employment) or the Disputes Tribunal.
